1. Definitions

In these terms and conditions:

• Bodycoat means Bodycoat Farm Equipment ABN 00 000 000 000
• Customer means any person or entity purchasing products from Bodycoat
• Products means all attachments, trailers, equipment, and goods sold by Bodycoat
• Website means bodycoatfarmequipment.com.au and all related domains
• Order means a confirmed purchase of Products from Bodycoat
• Delivery Date means the date agreed in writing for delivery of Products

2. Acceptance of Terms

By accessing or purchasing from Bodycoat Farm Equipment, you agree to be bound by these terms and conditions. If you do not agree, do not place an order. Bodycoat reserves the right to modify these terms at any time without notice. Continued use of the website or placing orders constitutes acceptance of modified terms.

3. Products & Pricing

3.1 Product Descriptions

All product descriptions, images, specifications, and pricing information on the website are provided in good faith but may contain errors or omissions. Bodycoat does not guarantee the accuracy or completeness of this information. Bodycoat reserves the right to correct any errors in pricing or product information at any time.

3.2 Pricing

All prices are in Australian dollars (AUD) and are subject to change without notice. Prices exclude GST unless otherwise stated. Bodycoat reserves the right to add taxes, duties, or other applicable charges at checkout. Pricing is valid only at the time of order confirmation.

3.3 Product Availability

Products are subject to availability. If a product becomes unavailable after order placement, Bodycoat will notify you and offer alternative options or a full refund at your request. Orders are not confirmed until payment has been received and processed.

4. Ordering & Payment

4.1 Order Placement

Placing an order on the website or by contacting Bodycoat directly constitutes an offer to purchase. Your order is not binding until Bodycoat issues a written confirmation including order number, items, price, and delivery estimate.

4.2 Payment Terms

Payment must be received in full before dispatch of Products, unless alternative payment terms have been agreed in writing. Bodycoat accepts:

• Credit card (Visa, Mastercard)
• Bank transfer / EFT
• Direct deposit
• Other methods as agreed

4.3 Payment Security

All credit card and payment information is processed through secure payment gateways. Bodycoat does not store credit card details on our servers. You are responsible for maintaining confidentiality of your payment credentials.

4.4 Late Payment

If payment is not received by the due date, Bodycoat may suspend or cancel your order without further notice. Any outstanding invoices may be subject to collection action and associated costs.

5. Delivery & Risk

5.1 Delivery Estimates

Delivery timeframes provided are estimates only and not guaranteed unless specifically confirmed in writing. Bodycoat is not liable for delays caused by courier services, weather, road conditions, or unforeseen circumstances beyond our control.

5.2 Delivery Costs

Delivery costs are calculated based on location, weight, and size. Delivery is arranged at the Customer's expense unless otherwise agreed. Bodycoat recommends freight insurance for high-value items.

5.3 Risk of Loss

Risk of loss or damage to Products passes to the Customer upon delivery to the delivery address or courier. Once delivered, the Customer is responsible for inspection and reporting any damage to the courier and Bodycoat within 48 hours.

5.4 Damage in Transit

If Products arrive damaged, the Customer must:

• Refuse delivery or note damage on delivery paperwork
• Report damage to the courier immediately
• Provide photos and documentation to Bodycoat within 48 hours
• File a claim with the courier's insurance

Bodycoat will cooperate with damage claims but is not liable for courier or transport damage once Products leave our facility.

6. Liability & Indemnity

6.1 Limitation of Liability

To the maximum extent permitted by law, Bodycoat's total liability to you for any claim, whether in contract, tort, or otherwise, is limited to the purchase price paid for the Products in question. Bodycoat will not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunity
• Loss of data or corruption
• Downtime or equipment unavailability
• Third-party claims or damages

6.2 Indemnity

The Customer agrees to indemnify and hold harmless Bodycoat, its directors, employees, and agents from any claim, damage, loss, or liability (including legal fees) arising from:

• Misuse, abuse, or improper operation of Products
• Failure to follow user manuals or safety guidelines
• Third-party claims related to the Customer's use of Products
• Unauthorized modifications or repairs
• Use of Products beyond their intended purpose

7. Returns & Refunds

• Change-of-mind returns accepted within 30 days for unused, unopened items
• Freight costs for returns are the Customer's responsibility
• Refunds are issued within 14 days of receipt and inspection of returned items
• Items showing signs of use or damage are not eligible for refund

8. Warranty Disclaimer

8.1 Limited Warranty

Bodycoat provides a 12-month manufacturer's warranty on Products against defects in materials and workmanship under normal use. This warranty does not extend to:

• Wear and tear (hoses, seals, teeth, wear plates)
• Damage from accidents, misuse, or abuse
• Unauthorized modifications or repairs
• Improper maintenance or storage
• Paint, cosmetic, or surface damage

8.2 Disclaimer of Other Warranties

To the maximum extent permitted by law, all products are provided "as is" without any other warranty, express or implied, including fitness for a particular purpose or merchantability. Bodycoat does not warrant that Products will meet your specific requirements or be error-free.

9. Intellectual Property

9.1 Website Content

All content on the website, including text, images, logos, specifications, and designs, is the property of Bodycoat or its licensors. You may not reproduce, modify, distribute, or transmit any content without written permission.

9.2 User Content

If you submit reviews, feedback, photos, or other content to Bodycoat, you grant Bodycoat a perpetual, royalty-free license to use this content for marketing and promotional purposes.

10. Governing Law & Dispute Resolution

10.1 Governing Law

These terms and conditions are governed by the laws of Queensland, Australia, without regard to its conflict of law provisions. Both parties submit to the exclusive jurisdiction of the Queensland courts.

10.2 Dispute Resolution

Any disputes arising from these terms or your purchase will be resolved as follows:

1. First, both parties will attempt to resolve the matter through good faith negotiation within 14 days
2. If unresolved, either party may refer the matter to mediation
3. If mediation fails, the matter may be referred to legal proceedings in Queensland courts

10.3 Entire Agreement

These terms and conditions, together with our Refunds & Returns Policy, Warranty Policy, and Shipping & Delivery Policy, constitute the entire agreement between you and Bodycoat. Any prior agreements or understandings are superseded.
